TERMS AND CONDITIONS

These terms apply to work bought from me directly, whether an original painting, an etching, or a limited edition print.

Buying

Work on this site is offered by enquiry rather than by immediate purchase. You write to me about a piece, I confirm whether it is still available, and we agree terms. Nothing is committed until I have confirmed the sale to you in writing.

Prices are in pounds sterling. Rachel Foister Ltd is not registered for VAT, so no VAT is charged.

Payment is by bank transfer unless we agree otherwise. Originals are paid in full before delivery, unless we have agreed a staged arrangement in writing.

Etchings and editions

An etching is an original print, not a reproduction. Each impression is pulled by hand from the plate, signed and numbered.

Impressions are pulled to order. Please allow around three weeks. A stated edition size is the maximum number of impressions that will ever exist; it is not a stock figure.

Because each impression is made by hand, small variations between them are inherent to the medium rather than defects.

Commissions

Commissioned work is agreed separately in writing, covering scope, size, timescale and payment stages. A commission is made to your specification, which means the cancellation rights described below do not apply to it. This is the ordinary position under the Consumer Contracts Regulations.

Delivery

I will agree delivery arrangements with you before dispatch. Works are packed properly and sent by an appropriate carrier, insured in transit. Delivery costs depend on size and destination and will be quoted before you commit.

Larger works may need specialist art shipping, particularly internationally. I will always tell you the cost before proceeding.

Risk passes to you on delivery. Title passes when payment has cleared in full.

International buyers: any import duty, customs charge or local tax is your responsibility, not mine.

Cancellation and returns

If you are a consumer buying at a distance, you have 14 days from receiving the work to change your mind, and a further 14 days to return it. Tell me by email. The work must come back in the condition it arrived, packed to the same standard, and the return is at your cost unless the work arrived damaged or was not as described.

I will refund you within 14 days of receiving it back.

This does not apply to commissioned work, which is made to your specification.

If a work arrives damaged, tell me within 48 hours with photographs, and I will put it right.

Nothing here affects your statutory rights.

Copyright

I retain the copyright in all my work. Buying a painting or a print transfers the physical object to you. It does not transfer copyright, which remains mine under the Copyright, Designs and Patents Act 1988.

That means the work should not be reproduced, copied, photographed for commercial use, or published without my written permission. You are of course free to photograph a work you own for your own private purposes, and to lend it, and to sell it on.

If you would like to reproduce a work, for a book, a catalogue, an article or anything else, write to me. I am usually glad to say yes.

The images on this site are published at a resolution suitable for viewing on screen and are not licensed for reproduction.

Resale

If you sell a work on through an auction house, gallery or dealer, the Artist's Resale Right may entitle me to a small royalty on the sale. This is a statutory right, handled by collecting societies rather than by me, and the seller's agent normally deals with it.

Visits are by arrangement. Please write to me first.

General

These terms are governed by the law of England and Wales.

If any part of them turns out to be unenforceable, the rest still stands.
